Introduction
These Terms and Conditions is between Palm and Sand Villas to you, the Client. By booking one of our travel services, you agree to comply with and be legally bound by these terms. Palm and Sand Villas is proudly part of The Travel Network Group (TTNG) as Independent Travel Expert (ITE) with ATOL protection U9197 and clients funds are deposited on the TTNG Travel Trust Account (TTA).
ATOL
The air holidays and flights shown are ATOL protected by the Civil Aviation Authority. We act as agents for licensed tour operators and the relevant ATOL number and ATOL certificate will be provided for each holiday booked.
The flight bookings we make are also ATOL Protected and the ATOL certificate will be provided for each flight booked.
ATOL Protection extends primarily to customers who book and pay in the United Kingdom. Click on the ATOL logo if you want to know more.
As Travel and Booking Agents we act only as Agents for the Principals actually providing the relevant services and we shall not be liable for any act or default on the part of any such Principal or its Agents or Servants. Passengers are booked and/or tickets and coupons are issued or obtained by us subject to the conditions regulations and terms of the Carriers and/or Principals concerned.
Website and Social Media Travel Offers
Prices are ‘per person’ based on 2 sharing (unless stated) and are subject to availability and change. Hotels are subject to live availability and price and subject to change without any notice, if fully booked, local hotels of a similar standard will be provided. Hotel ratings are based on local standards. Tours are subject to availability and change and some tours may command a supplementary cost. Ports of call on some coach tours/cruises may vary according to unforeseen circumstances. All deals are fully TTA & ATOL protected.

Booking Procedure
To confirm your booking, a minimum deposit of 50% of the total cost is required, or as advised by Palm and Sand Villas. Full payment is necessary if booking within 14 weeks of departure.
Payments are made online through the payment link provided, and in GBP sterling. If we are unable to accept your booking, your deposit will be refunded.
Higher deposits may be required during peak seasons, and you will be informed of these at the time of booking.
Special requests, such as dietary needs or specific facility needs, should be made in writing prior to booking. While we endeavor to meet these requests, we cannot guarantee fulfillment.
Upon receiving the correct deposit, we will confirm your arrangements and issue a Confirmation Invoice, establishing a contract.
For bookings including flights, you will need to provide complete names as per passports and other relevant details for all travellers. It’s crucial to review the Confirmation Invoice and ATOL Certificate, where applicable, upon receipt to ensure all details are correct.
The balance of your payment is due 14 weeks before departure. Failure to pay on time may result in cancellation with applicable charges.
A security deposit of 20% of the total price, or higher if required, must also be provided at the time of booking to cover any potential damages or unpaid charges during your stay.
Insurance
It is a booking condition of package travel regulations that you have adequate travel insurance. Passengers must take out travel insurance and details of our special facilities are available. Neither we nor any of our Agents or Servants shall be liable or responsible for any loss, damage, and injury. Delay or inconvenience whatsoever to any traveller or their luggage or other personal property sustained or suffered in, or during, any passage, journey, trip or stay, or in respect of any accommodation or in the carrying out of any arrangements booked through us. In the case that you decline insurance you may be asked to sign an indemnity form, or provide details of alternative cover. No insurance will be issued until the full premium has been received.
Payments
We reserve the right to adjust prices and times given or quoted should circumstances make necessary. Prior notice will be given in most circumstances. We can only guarantee against fare increases when the full balances are paid in full at time of booking. All deposits paid are non refundable. For any travel arrangements, we reserve the right to add “admin fees” to cover the cost of putting together was we categorise as “complex” travel package, which requires more time to put together; these fees are non-refundable.
Alterations
Our receipt of a deposit and the lodging of a booking form does not constitute confirmation of the booking. Confirmation or otherwise is given separately in a form of an ATOL certificate and confirmation for flight inclusive bookings.
Confirmation
Passengers should assume that all bookings made aresold on a totally non-refundable basis unless otherwise advised by us. All cancellations by a client must be in writing. If a client cancels a booking the deposit will be retained by us as fee to cover expenses, but clients are liable for all expenses and liabilities incurred by us if these exceed the deposit.
Amendments and Cancellations
Amendments: If you wish to modify your booking, please submit your request in writing. While we will endeavor to accommodate changes, they may incur a fee of £50 per person, plus any additional costs incurred by Palm and Sand Villas, regardless of whether the change can be confirmed. Note that changes within 28 days of departure may be treated as cancellations, with respective charges applying.
Transfers: You may transfer your booking to another person if you are unable to travel, subject to a £50 transfer fee per person and any additional costs. This must be arranged no less than 7 days before departure. Both you and the transferee will be responsible for full payment.
Cutting your trip short: If you need to end your holiday early, Palm and Sand Villas cannot offer refunds for unused parts of your trip or cover additional expenses. It is advisable to check if your travel insurance covers early return scenarios and to file any claims for curtailment directly with your insurance provider.
Re-booking: If you decide to cancel your holiday and then choose to re-book another one, the re-booking will adhere to our standard cancellation terms. If the new booking requires a higher deposit than what has already been paid, taking into account any cancellation fees already deducted, the difference must be paid immediately to secure the new reservation.
These procedures ensure clarity and fairness in managing booking adjustments and cancellations, protecting both the interests of the guests and Palm and Sand Villas.
Amendments made by us: Palm and Sand Villas strives to ensure the accuracy of the information in its brochures and website and all marketing materials. However, changes can occur, and we reserve the right to make adjustments without prior notice.
If there are any significant modifications to your holiday, such as a major change in flight times or accommodation standards, you will be promptly informed and offered option available at the time. For minor changes, like slight flight adjustments or facility requirements due to health guidelines, we will inform you but such changes will not generally affect the overall holiday experience. If a significant change occurs, you must indicate your choice as soon as possible of our notification, and within a 72 hours deadline.
If no response is received within 72 hours after our initial notification of a significant change, we will contact you again to confirm your decision. Failure to respond after this follow-up will lead us to assume acceptance of the proposed change or alternative arrangements. If we are not able to offer alternative arrangements, we will discuss directly with the client to find the best way forward; this cannot be the ground for refund or compensation claims. .
Force Majeure
Please remember to carefully review your travel insurance policy to ensure it covers the criteria for “unavoidable and extraordinary circumstances”, such as pandemics or natural disasters. This protection is crucial for safeguarding against unexpected changes that prevent your holiday from proceeding as planned.
Force majeure refers to unforeseeable circumstances that prevent someone from fulfilling a contract. This could include natural disasters like earthquakes, tsunami or hurricanes, war, riots, terrorism, or other major security risks, and significant public health risks such as epidemics or any government-imposed restrictions.
When such situations occur, Palm and Sand Villas is not obliged to provide refunds or compensation if significant portions of your holiday are affected after commencement. However, we will make every effort to offer suitable alternative arrangements unless the disruption itself is directly due to Force Majeure. In such cases, the usual provisions for alternative arrangements do not apply, and the focus may shift to ensuring a safe return to your point of departure if possible.
When force majeure is declared, the usual obligations and penalties of a contract, such as cancellation fees, may not apply because the circumstances are beyond the control of the parties involved.
If you book accommodations only, this cancellation policy does not apply and will be the one of the supplier. Always check current travel advisories from relevant authorities before your departure to ensure your safety and compliance with legal travel guidelines.
Claims
In the event of a claim, our maximum liability is restricted to the total amount paid to us by the claimant less any expenses incurred.
Forfeiture of Reservations
All final balances must be paid at least 14 weeks before departure or the date given at time of booking in writing or orally. If they are not paid we reserve the right, which may be exercised without any notice to the passenger whatsoever, to cancel the reservation and retain any balances.
Liabiity
Palm and Sand Villas cannot be held liable for any losses or damages that were unforeseeable based on information provided by you prior to contract acceptance.
We are not responsible for services or facilities not included in our agreement, such as external excursions or amenities offered by third parties. Descriptions of properties and services are provided in good faith based on the latest information.
Public utility failures, internet connectivity issues, and the presence of wildlife at our properties are beyond our control, and we cannot guarantee immediate resolution.
Our responsibility is also limited by our suppliers’ terms and conditions, which may restrict their liability. We are not responsible for operational decisions by carriers that affect travel schedules. Adequate travel insurance is recommended, as our ability to compensate is governed by international conventions and limited to scenarios excluding force majeure and beyond our operational control.
We assume no responsibility for the occurrence of any animals or insects in or around the properties. Our liability does not extend to fraud, death, or personal injury caused by our negligence, except as prohibited by law.
Palm and Sand Villas does not accept liability for any restrictions or limitations you may encounter at your destination based on race, gender, or sexual preference. While we provide general information as required, it is your responsibility to ensure the chosen destination meets your personal expectations and needs.
Additionally, we are not liable for any unforeseen damages, losses, or expenses related to business impacts or indirect consequences that could not have been anticipated based on the information provided by you at the time of booking.
Passport, visa and Health Certificate
Passengers must be in possession of a valid passport and necessary visa(s) and health certificates. In case of passengers being refused entry by any immigration or other Authority all repatriation costs are to be borne by the passenger. Reconfirmation & Validity of Ticket
Where a passenger has to reconfirm a flight or return booking it is their responsibility for any inconvenience or loss caused by not doing this.
Return tickets are only valid for dates specified on the tickets unless a change is made by the airline, or at the passengers request and make an additional charge at our discretion.
Information Provided By You
Information given by the client upon booking is accepted by Palm & Sand Villas as being correct unless subsequently amended in writing. We therefore do not accept any responsibility whatsoever, for any inconvenience or financial loss caused by wrong information being supplied to us.
Travel Advice
Before booking your travel, it is crucial to consult the travel advisories issued by the government of your home country, the government that issued your passport and/or visa, and the government of your destination.

If you choose to travel against the advice of these authorities, you assume all risks associated with your decision, including potential loss, injury, or damage. Ensure your passport and visa meet all destination requirements, which may change and should be verified prior to departure.

Air Ticket
When you book flights with us, flight tickets will be issued shortly before your departure. It is your responsibility to verify that the names and flight timings on your tickets match those on your passport.
Note that flight times may be subject to change after your confirmation invoice has been issued. You must check in for flights on time and are responsible for presenting yourself for all pre-booked components of your holiday. The company is not responsible for delays caused by force majeure or if you miss flights due to late check-ins. No refunds or credits will be issued for missed components of your holiday or for lost, misplaced, or destroyed travel documents.
Tickets posted to clients are done so at the client’s risk. Any costs arising from non-delivery will be borne by the client. For late bookings collection of tickets at the airport will be arranged charges will apply.
Change of Requested Travel Arrangements
All requests by passengers to alter booking or travel arrangements must be writing or made in person. Should a firm booking already be held a charge of minimum of £150 will be made to change the dates of travel subject to conditions of booking/ticket and availability.
Cancellation
You, or any member of your party, may cancel your travel arrangements at any time. Written notification from the person who made the booking (lead party) must be received and confirmed by email only.
Cancellations: All cancellations must be in writing and are effective from the date received by us. Cancellation charges will apply based on the proximity to your departure date, with a 100% charge if less than 70 days notice is given, or if you cancel during the holiday. Cancellation charges will be deducted from any payments already made.
Cancellation by the Client: Clients must submit cancellation requests in writing by the person who made the initial payment. Cancellations take effect on the day they are received by us. Cancellation charges are based on how close the cancellation is to the departure date, and these will be deducted from any payments already made. Note that certain bookings, especially during peak seasons, may have stricter conditions, and some arrangements cannot be changed after confirmation without incurring a fee up to 100% of that portion of the trip. We highly recommend securing comprehensive travel insurance to cover potential losses from cancellations.
Cancellation charges: Since we incur costs in cancelling your travel arrangements, you will have to pay the applicable cancellation charges up to the maximum shown below: Period before departure within which written cancellation is received by us. Note: if the reason for cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges. The full insurance premium may be retained in the event of cancellation.
* Bookings that include Budget/Low Cost or Schedule Flights and/or cruise may incur different cancellation charges. Please enquire at the time of booking or ahead of making the decision to cancel.
Guest Conduct and Property Usage
Adhering strictly to occupancy rules is crucial. Only individuals listed on your Confirmation Invoice are permitted to use the property unless prior arrangements are made in writing. The occupancy must not exceed the designated sleeping capacity, except for infants under two years, though some properties may limit the number of infants. Exceeding these limits without prior consent may result in additional charges or termination of your stay without a refund.
Photography or filming at the property for commercial purposes is prohibited without the Palm and Sand Villas / Supplier / Property Owner’s authorisation. The primary booker (Lead Party) is responsible for ensuring all guests behave appropriately. Failure to comply may lead to eviction without any refund.
The property will be clean upon your arrival and should be left in a similar condition at departure, as per the guidelines in the welcome book. You are responsible for any damages or extra charges incurred during your stay and must settle these costs before departure. Failure to do so authorises Palm and Sand Villas / TTNG / ITE to deduct the necessary amounts from your security deposit.
Rental Property Description Accuracy
We strive to ensure that all property descriptions, details, and prices in our literature are accurate, based on thorough inspections and information received from suppliers. However, changes can occur, sometimes with short notice.
Should any alterations to our advertised properties arise, we will inform you at the time of booking or, if the booking has already been made, as soon as possible thereafter. It is important to note that not all elements of the holiday are within our control; advertised facilities may become unavailable due to various unforeseen circumstances such as weather conditions, emergency repairs, or lack of demand.

Data Protection
In order to process your booking and to ensure that your travel arrangements run smoothly and meet your requirements we need to use the information you provide such as name, address, any special needs/dietary requirements etc.
We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass the information on to the relevant suppliers of your travel arrangements such as your tour operator, airlines, hotels, transport companies etc. The information may also be provided to security or credit checking companies, public authorities such as customs/immigration if required by them, or as required by law.
Additionally, where your holiday is outside the European Economic Area (EEA), controls on data protection in your destination may not be as strong as the legal requirements in this country. We will not however, pass any information onto any person not responsible for part of your travel arrangements. This applies to any sensitive information that you give to us such as details of any disabilities, or dietary/religious requirements. (If we cannot pass this information to the relevant suppliers, whether in the EEA or not, we cannot provide your booking. In making this booking, you consent to this information being passed on to the relevant persons.)
Usually your tour operator or other principal will pass this information onto their suppliers once we have provided it to them. The tour operator or other principal’s use of your information is subject to their policy, both in respect of your booking and any future marketing, and is their responsibility. Please ask either us or them for a copy of this if you would like to see it.

Jurisdiction
All agreements between the traveller(s) and Palm and Sand Villas and any and all its sister brands shall be governed by English Law and within the exclusive jurisdiction of English Courts.
